TWO brothers from Southern Cross were given jail terms for assaulting a man at the Club Hotel.
The pair and another man from Kalgoorlie Boulder were drinking and playing pool at the Club Hotel in Southern Cross on October 17, 2008.
Late in the evening they attacked an Aboriginal man without provocation, inflicting serious head injuries.
At a trial in Southern Cross on September 16, Magistrate Musk found Jason Noone (32) of Libra Place and Timothy Noone (25) of Spica Street were found guilty of assault occasioning bodily harm when they went to trial in Southern Cross Magistrate’s Court on September 16.
The pair were remanded in custody for a pre-sentence report, then appeared via video link on October 25 before Magistrate Musk at Northam Magistrates’ Court.
Jason Noone was sentenced to 14 months imprisonment.
Timothy Noone was sentenced to one year imprisonment suspended for two years, with an order to pay $3,000 in compensation to the victim.
The third man, Paul Chidgey (26) of Millen Street, Kalgoorlie-Boulder was also charged for his part in the assault.
He pleaded guilty on August 5 in Kalgoorlie court and was sentenced to two years’ imprisonment.
